Sometimes they’re frustrated because they feel that the developer’s rep misled them. Many of those people feel cheated. The developer requires them to pay annual fees on the property, but the property isn’t available when they want to vacation.
People don’t have set schedules. They need flexibility when planning vacations. During the timeshare presentation, our clients heard promises about ease of access to the timeshare. Some reps promised to offer “concierge services,” offering to book the reservation. Once our clients signed the contract, however, all communications ceased with the rep who pressured them into signing the debt obligation.
That’s not fair!
People shouldn’t be forced to abide by timeshare contracts if the developer failed to live up to what the rep promised during the sales presentation. As stated in our free Timeshare Compliance Manual, each state has its own laws apply to timeshare sales. Many of those states offer rescission periods—providing timeshare owners with an absolute right to cancel the timeshare contracts. The problem is that time limitations exist. If the owner exercises the right within a given timeframe, usually less than one month, the developer must cancel the contract and return the funds. When the rescission period expires, the developer may misinform the owner again—saying that the timeshare owner can no longer cancel.
Fortunately, consumer protection laws exist that allow people to cancel timeshare contracts for fraudulent misrepresentations even after the rescission period ends. Those laws are more complicated, and they may require counsel to navigate the particular legal codes that prevail.
